Court of Cassation decision_Orange Caraïbes-Digicel

Orange was ordered to pay damages to Digicel for anti-competitive practices in the mobile telephony market in the Antilles-Guyana area. These practices included loyalty offers, price differentiation, exclusivity clauses, etc. Digicel suffered stagnating market shares and additional costs. Orange disputed Digicel’s arguments, but the Court upheld the sentences, concluding that the losses were indeed attributable to Orange’s anti-competitive practices. In particular, the Court took into account the work carried out by TERA to estimate Digicel’s losses.
